Agreement covers both Products you choose to distribute for free and Products for which you charge a fee…”  “The price you set for Products will determine the amount of payment you will receive.”

7 www.lexia.fi Ovi Store Ovi Store Publisher Registration and Distribution Agreement  Lyhyet ja suhteellsien tasapainoiset ehdot  Sovelluksille vaaditaan etukäteishyväksyntä; Content Submission and Selection:  “Nokia may determine in its sole discretion that Your Content does not comply with the submission documentation and Program requirements then in effect, or reject Your Content for distribution for any reason even if it meets the submission documentation and Program requirements.”  Sovellettavaksi Suomen laki!

8 www.lexia.fi Ovi Store  Sama sopimus kattaa sekä maksulliset että maksuttomat palvelut  “Nokia shall pay You seventy percent (70%) of the Net Revenue attributable to purchases of Your Content by end users that pay by credit card; and sixty percent (60%) of the Net Revenue attributable to purchases of Your Content by end users that pay using operator billing.”  Net Revenue> “Purchase prise actually received by Nokia for Your Content from the end user, net of returns, refunds and bad debt, less all applicable taxes levied on sales, consumption, or based on revenue”  Oikeudet pysyvät kehittäjällä  “Nokia does not claim ownership in Your Content and Your submission of Content for the Program does not transfer ownership rights in the Content to Nokia.”  Huom! ”…You grant to Nokia a non-exclusive, worldwide, irrevocable during the term of this Agreement, royalty-free right and license to use, copy, publicly perform, display, and distribute the Content in connection with the Program.”

10 www.lexia.fi Yhteenvetoa  Tulon- ja oikeuksienjako yhteneväinen  laskentaperuste voi hiukan vaihdella  non-exclusiivinen lisenssi (myös kehittäjän brändiin, laaja käyttöoikeus)  Ei vastuunrajoituksia kehittäjälle + laajat warrantyt  kattava indemnifikaatiolauseke kaikissa  Ei saa käyttää fasilitoimaan tuotteen jakulua palvelun ulkopuolella…  You may not use the Program to distribute or make available any Content whose primary purpose is to facilitate the distribution of Content outside of the Program.  Ainakin App Storen osalta hyvä käyttää asiantuntijaa…  “The relationship between You and Apple established by this Schedule 1 may have important legal consequences for You. You acknowledge and agree that it is Your responsibility to consult with Your legal advisors with respect to Your legal obligations hereunder.”
